The lawyer in Spain

Why we always advise you to get your own independent lawyer, who looks after your interests only during a real estate transaction.

You are buying in Spain, a country with different laws and customs than you are probably familiar with. Furthermore there is usually a large sum of money involved so it would be wise to make sure that you have someone on your side that knows what must be done.

A lawyer researches everything that is important to the good outcome of a transaction. Is the one who says who is the owner, actually the owner. Is there a mortgage or any other debts on the property and if so how will they be taken care of when the property is sold. Regarding new builts you need clauses that ensure that the money paid is safe, are all licences in order. What happens when things go different than agreed upon? Etc, a lawyer takes care of these things.

Usually a lawyer charges 1% plus 16% vat of the cost price of the property.

A lawyer should be independent, thats why you should not use a lawyer of a builder or use a lawyer that also works for the selling party. Even a lawyer recommended by us could by biased so we prefer you getting your own lawyer. Of course we can always recommend several if no one comes to mind.
